Gigs App - Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Gigs mobile application, website, and related services (collectively, the "App" or "Platform"), operated by Gigs App ("Gigs", "we", "us", or "our").

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you may not use the App.

1. Overview of the Gigs App

Gigs is a marketplace platform that connects people who want to book services ("Buyers") with independent service providers ("Sellers") in South Africa.

We do not employ Sellers. They are independent contractors, not our employees, partners, or agents.

No digital or online services are supported at this time. All services are in-person. Depending on the option offered for a service and selected for a booking, the Seller may travel to the Buyer or the Buyer may travel to the Seller's service location. Photography bookings are fulfilled at the location specified by the Buyer.

The App currently focuses on the following service categories only:

Any service that does not fall within these categories is not allowed on Gigs.

2. Eligibility and Accounts

2.1 Age requirements

You must be at least 13 years old to create and use a Buyer account on the App.

If you are under 18, you confirm that you have obtained permission from a parent or legal guardian, and that they accept these Terms on your behalf.

You must be at least 18 years old to create, operate, or receive payouts through a Seller account.

By using the App, you represent and warrant that you meet the age requirements for the type of account you use, have the right, authority, and capacity to agree to and comply with these Terms, and that the information you submit to us is accurate and up to date.

2.2 Account registration

To use certain features of the App, you must create an account and provide accurate, current information. You agree to keep your login credentials secure, not share your account, and promptly update your information if it changes.

You are responsible for all activities that occur under your account.

3. Role of Gigs App

3.1 Marketplace only

Gigs provides a platform where Buyers and Sellers can find each other, communicate, arrange bookings, and process supported payments.

We do not provide or perform the actual services listed on the App.

Sellers are solely responsible for the services they offer and provide.

Buyers are solely responsible for choosing Sellers and for any arrangements made with them.

Any agreement for services is directly between the Buyer and the Seller, not between the user and Gigs.

3.2 No employment relationship

Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between Gigs and any user. Sellers act as independent contractors and are fully responsible for complying with all applicable laws, including tax obligations.

4. Permitted and Prohibited Services

4.1 Allowed categories (for now)

The Platform is currently limited to the following categories:

4.2 Prohibited services

The following are strictly prohibited on Gigs:

We may remove any service, profile, or content that we reasonably believe falls outside these categories or appears unsafe, illegal, fraudulent, or otherwise inappropriate.

5. User Conduct and Community Rules

Any behaviour that does not align with these Terms may result in warning, content removal, booking cancellation, suspension, account restriction, or account termination.

6. Content and Intellectual Property

6.1 Your content

Users may upload or submit content, including profile information and photos, gig descriptions and pricing, reviews and ratings, messages, and other materials.

You remain the owner of your content, but by posting it on the App you grant Gigs a non-exclusive, worldwide, royalty-free, sublicensable and transferable licence to use, display, host, store, reproduce, modify, and distribute your content in connection with operating, promoting, and improving the Platform.

You represent and warrant that you have all necessary rights to the content you upload and that your content does not infringe any third-party rights or violate any laws.

6.2 Our content

The App and all related content, including logos, branding, design, and software, are owned by or licensed to Gigs and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App or its content, except as allowed by these Terms or with our prior written permission.

7. Bookings, Payments and Fees

7.1 Booking process

Buyers can browse services and submit booking requests to Sellers. For a booking at the Seller's location paid by card, confirmation requires the Buyer's full card authorization and the Seller's acceptance. For an eligible cash booking at the Seller's location, confirmation requires the Seller's acceptance. For a house call, confirmation requires the Seller's acceptance, any travel fee, and the Buyer's authorization of the full final total.

Card authorization is currently available only for bookings scheduled within the next five days and totals of at least R25. The booking location type selected for a request cannot be changed for that booking.

7.2 Payment methods

Gigs supports cash for eligible bookings at the Seller's location and card for eligible bookings at either location type. House calls require card authorization and do not offer cash.

For a current card booking, the Buyer authorizes the full amount shown in the App. An authorization reserves funds but is not a completed charge. The amount is normally captured only after the Seller completes the service using the Buyer's completion code. An eligible cancellation or no-show may instead cause part of the authorization to be captured and the balance released.

Card payments are processed by Paystack, or any future payment partner, not by Gigs directly. Gigs does not hold card funds in a stored-value wallet or internal Seller balance.

7.3 Platform and transaction fees

Unless a promotion or different rate disclosed by Gigs applies, Gigs charges Sellers a platform commission of 15% of the completed booking amount, capped at R100 per booking.

For card bookings, commission and any authorized recovery of a Seller's outstanding Gigs balance may be deducted through settlement. For cash bookings, commission is recorded as an amount the Seller owes Gigs and may be recovered from a later card settlement, or new bookings may be restricted until the balance is reduced.

Paystack or another payment provider may also apply processing or settlement fees according to its rules and the payment configuration used for the transaction.

7.4 Cancellations and refunds

Buyers and Sellers may cancel an active booking until it has been completed or fully paid.

A Seller may cancel an active booking before it is completed or fully paid, but repeated or abusive cancellations may lead to warning, suspension, or termination of their account.

For a current card-authorized booking, Buyer cancellation more than 24 hours before the scheduled start normally releases the full authorization. Buyer cancellation 24 hours or less before the scheduled start may capture 20% of the authorized total and release the remainder. Seller cancellation normally releases the full authorization. A verified Buyer no-show may capture 20%, while a verified Seller no-show normally releases the full authorization.

Cash bookings create no card hold to capture or release. Cancellation and no-show charges apply only to the extent permitted by law. No cancellation charge will be imposed where applicable law prohibits it, including where section 17(5) of the Consumer Protection Act applies because the person for whom the booking was made cannot attend due to death or hospitalization. Gigs may request reasonable supporting information and may also waive or adjust a charge for supported exceptional circumstances.

Gigs may record, request, or help initiate releases, refunds, reversals, or payment adjustments in limited circumstances, including card authorization scenarios, duplicate or failed payment scenarios, fraud or misuse investigations, no-show outcomes, or where required by law, card network rules, or payment processor requirements.

Not every service complaint qualifies for a refund, and some disputes may still require direct engagement between the Buyer and the Seller.

Because Gigs is not the provider of the underlying in-person service, Gigs may distinguish between payment and platform issues that we can review directly, and service quality or performance disagreements that may depend on the facts provided by the Buyer and Seller.

8. Disputes Between Users

If a problem arises, for example quality of service, no-shows, late arrivals, harassment, fraud, property damage, impersonation, or off-platform payment abuse, users should first try to resolve the issue directly where appropriate.

Gigs also operates trust and safety, dispute-review, and moderation processes. We may review complaints, booking records, in-app communications, verification records, and other relevant platform evidence to assess reports and take appropriate action.

Depending on the case, Gigs may warn or restrict an account, suspend or block an account, cancel a booking, review eligibility for a card-authorization release, legacy booking-deposit refund, or settlement outcome, request more information from the parties involved, or take other reasonable platform or safety actions.

Gigs does not act as a court or a guaranteed arbitration service, and we do not promise a particular outcome in every dispute, especially where a complaint is subjective or evidence is limited. However, we do actively review safety, fraud, misconduct, and eligible payment-related disputes on the Platform.

9. Safety, Verification, Screening, and Assumption of Risk

9.1 Verification and screening

Gigs currently performs internal provider review before a Seller profile can go live. This may include profile, ID/selfie, payout account, service/category, booking, report, and other marketplace risk information. Gigs does not currently claim to perform external background checks on every Seller, but may introduce third-party screening or additional due diligence in the future.

Approval to use the Platform does not guarantee that a user will never engage in harmful conduct, but verification and screening are part of our efforts to reduce risk and improve trust on the Platform.

9.2 Your responsibility and risk

Because services happen in-person and often in private or semi-private locations, users should act carefully and take reasonable safety precautions.

You are responsible for your own choices, including where you meet, who you choose to work with, and any precautions you decide to take.

While Gigs may apply verification, screening, moderation, and platform safeguards, we cannot guarantee the conduct of every user or the outcome of every in-person interaction.

10. Changes to the App

Features, design, and functionality may change frequently. The App may occasionally contain bugs, errors, or interruptions. Some features may be launched, modified, or removed without prior notice.

We may update, suspend, or discontinue any part of the App at any time.

11. Third-Party Services and Links

The App may use or integrate with third-party services, including payment providers, map and location services, push notification providers, analytics providers, and hosting, authentication, and other infrastructure services.

Your use of these services may be subject to additional terms and privacy policies of those third parties. Gigs is not responsible for the content, terms, or policies of third-party services.

12. Account Suspension and Termination

We may suspend, restrict, or terminate your access to the App, with or without notice, if you violate these Terms or any policies referenced in them, engage in behaviour that we consider harmful, unsafe, fraudulent, abusive, or misleading, repeatedly cancel bookings in bad faith, are frequently reported by other users, fail verification, screening, compliance, or payout review requirements, or if we believe your continued use of the App creates risk for Gigs, other users, our service providers, or our compliance obligations.

You may stop using the App and request account deletion at any time, subject to any legal or legitimate business need for us to retain certain data, as explained in the Privacy Policy.

Termination of your account does not remove your responsibility for obligations that arose before termination, for example unpaid fees or legal obligations.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the App and all content and services are provided on an "as is" and "as available" basis.

While Gigs uses reasonable efforts to operate the Platform reliably and to apply safety and compliance controls, we do not warrant that the App will be uninterrupted, secure, or error-free, that any information or content on the App is accurate, complete, or up to date, or that any particular service outcome or booking will meet your expectations.

14. Limitation of Liability

To the fullest extent permitted by South African law, Gigs and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, any loss of profits, revenue, business, data, or goodwill, or any personal injury, property damage, or other harm arising out of your use of the App, your interactions with other users, or any in-person meetings or services arranged through the App.

To the extent we can be held liable, our total liability to you for any claim arising out of or relating to the App or these Terms will be limited to the total amount of fees, if any, you paid to Gigs through the App in the six (6) months immediately before the event giving rise to the claim.

Some laws may not allow certain limitations of liability. In such cases, these limitations apply only to the extent allowed by law.

15. Indemnity

You agree to indemnify and hold harmless Gigs and its directors, employees, and affiliates from and against any claims, damages, liabilities, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the App, your violation of these Terms, your violation of any law or third-party right, or any service you provide or receive through the App.

16. Changes to These Terms

We may update or modify these Terms from time to time. When we do, we will update the "Last updated" date at the top of this document, and we may provide notice within the App or by email where appropriate.

If you continue to use the App after the updated Terms become effective, you are deemed to have accepted the changes. If you do not agree with the new Terms, you must stop using the App and may request account deletion.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.

You agree that before taking any formal legal action, you will first contact us at support@gigs-app.co.za to attempt to resolve the issue informally.

If we cannot resolve the dispute informally within a reasonable time, any dispute, claim, or controversy arising out of or related to these Terms or your use of the App shall be submitted to the courts of South Africa, with primary venue in or near Potchefstroom, North West Province, unless another venue is required by law.

18. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and Gigs regarding the App.

Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision in these Terms shall not be considered a waiver of that right or provision.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms without restriction, in connection with a merger, sale, or other corporate transaction.
