This Privacy Policy explains how Gigs App ("Gigs", "we", "us", or "our") collects, uses, stores, and protects your information when you use the Gigs mobile application and the website at gigs-app.co.za.

By using the App or Website, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use Gigs.

1. Who We Are and How to Contact Us

Gigs App is a platform that connects Buyers with independent Sellers offering in-person services in South Africa, currently in Photography, Tutoring, Female Beauty, and Male Grooming.

2. Information We Collect

We collect information you provide directly, information collected automatically when you use the App or Website, and information from third-party services we use, such as payment, analytics, hosting, mapping, messaging, and compliance-related partners.

2.1 Information you provide to us

When you create and use an account on Gigs, we may collect account and profile information such as your full name, username or display name, email address, phone number, password (stored in encrypted or hashed form through our authentication provider), profile photo, date of birth or age, residential or service-area details, and optional demographic and onboarding information such as gender, race, occupation, institution, and interests.

For Sellers, we may also collect service and portfolio information, AI feature inputs when you choose to use AI tools, ID and selfie verification materials, verification decisions and related review records, and bank or payout account details for receiving payments via Paystack.

We may also collect support requests, reports, appeals, forms, feedback, and emails sent to us.

2.2 Location information

Because Gigs is for in-person services, we make use of location data. We may collect device GPS location when you permit it, as well as selected or saved locations such as your service area or booking location.

Seller profile location is generally shown at a broader level, such as suburb or town. During service delivery, location can be more precise.

2.3 Booking, payment, and usage information

We may collect booking details such as the booked service, Buyer and Seller, booking time, booking status, and service location.

We may also collect payment-related information such as price, applicable fees, payment status, references, timestamps, and limited transaction metadata, including records of past payments, payouts, refunds, reversals, and related platform actions.

Card details are handled by our payment partner, currently Paystack. We do not store your full card number or CVV on our own servers.

2.4 Messages and communications between users

Buyers and Sellers can communicate through in-app chat. We store this communication so users can view their conversation history and so we can support moderation, trust and safety, dispute review, and compliance processes where appropriate.

2.5 Photos and other content

We store media you upload, including profile photos, service photos, portfolio images, and verification-related images where required.

2.6 Device and technical data

When you use the App or Website, we may automatically collect device type and model, operating system and version, app version, IP address, and log data such as sign-in times, feature usage, errors, and crashes.

2.7 Cookies and similar technologies (Website)

On the Website, we may use cookies or similar technologies to remember preferences, understand usage, and improve performance and design.

3. How We Use Your Information

We use the information we collect to operate the App and Website, process bookings and payments, communicate with users, support safety and misuse prevention, improve the product, generate or import seller content when you choose optional AI tools, and, where permitted, send marketing and promotional messages.

This includes verification, screening, moderation, trust and safety, fraud review, and compliance-related reviews where appropriate.

4. Legal Basis and Compliance

We rely on a combination of legal bases to process your information, including consent, contractual necessity, legitimate interests such as fraud prevention and user safety, and legal obligations such as tax, accounting, compliance, and anti-fraud requirements.

5. How We Share Your Information

5.1 With other users

To operate the marketplace, we share certain information between Buyers and Sellers, such as names or usernames, profile photos, service descriptions, service areas, ratings, reviews, booking details, and service locations where relevant.

5.2 With service providers and partners

We use third-party providers and partners such as Paystack, Firebase, Google Cloud, mapping providers, notification services, analytics tools, support services, identity or compliance-related partners, and AI processors such as OpenAI when you choose to use AI writing or import tools.

When you use optional AI features, we may send the relevant text, extracted OCR text, service category, selected services, plaque setup, seller display name, location context, and existing draft text to AI processors such as OpenAI so they can generate or import content for you. Please do not include private or sensitive information in AI prompts or plaque import images, and review AI output before saving it.

5.3 For legal, safety, and compliance reasons

We may disclose information where reasonably necessary to comply with law, enforce our Terms, protect users or partners, detect or prevent fraud or abuse, or address security, compliance, or technical problems.

5.4 Business transfers

If Gigs is involved in a merger, acquisition, sale of assets, or similar transaction, your information may be transferred as part of that deal.

6. Payment Information

All card payments are processed by Paystack or other licensed payment partners, not directly by Gigs.

We may store limited transaction-linked information and Seller payout account details where needed for payouts and compliance. We do not store your full card number or CVV on our own systems.

7. Data Retention

We keep information for as long as reasonably necessary to operate the App, maintain records of bookings, reports, disputes, and transactions, comply with legal and compliance obligations, prevent fraud, and enforce our Terms.

Some information may be retained for longer where legally required or where necessary for safety, fraud-prevention, security, moderation, or compliance reasons.

8. Your Rights and Choices

Subject to applicable law, you may have rights to access, correct, delete, object to, restrict, or withdraw consent relating to your personal information. To exercise these rights, contact support@gigsapp.co.za. For account deletion requests, you can also use https://gigs-v1-app.web.app/delete-account. We may need to verify your identity before responding.

9. Children and Teens

The Gigs App is not intended for children under 13. We do not knowingly collect personal information from children under 13.

Users aged 13 to 17 should only use Buyer features with the permission and supervision of a parent or legal guardian.

Seller accounts and payout-enabled seller activity are intended only for adults aged 18 and older.

10. Security

We use reasonable technical and organisational measures to protect your information, including reputable cloud infrastructure, access controls, security rules, and verification, moderation, and compliance review controls where appropriate.

However, no system is completely secure, and we cannot guarantee absolute security.

11. International Transfers

Our servers and service providers, such as Firebase, Google Cloud, and Paystack, may be located outside South Africa. By using Gigs, you understand that your information may be transferred to, stored, and processed in other countries.

12. Third-Party Links and Services

The App and Website may contain links to third-party websites, services, or apps that are not operated by Gigs. We encourage you to review their privacy policies before providing them with personal information.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date and may also notify users of significant changes through the App, Website, or email.
